VAT collection: Governor Wike Takes Battle To Supreme Court

The battle on which authority has the right to collect Value Added Tax (VAT) is now in the Supreme Court.

Rivers State Governor Nyesom Wike has taken the battle to claim the VAT collected in his state to the Supreme Court.

The government has asked the apex court to set aside the “maintain status quo” order given last week by the Court of Appeal to enable him implement the state law which empowers it to collect the VAT.

The Court of Appeal gave the order pending the determination of the prayer by the Federal Inland Revenue Service (FIRS), which sought to upturn the judgment of the Federal High Court sitting in Rivers endorsing the collection of the tax by the state government.

On Tuesday, the Ogun State government, one of the states with the highest VAT collections, joined the fray.

The bill to empower the state government to commence collection of VAT in its domain passed the second reading of the House of Assembly. It will go into public hearing before its passage.

The VAT has been collected by the FIRS on behalf of the Federal Government since 2004.

It is shared at 50 per cent among states and 38 per cent among the 774 local governments. The Federal Government takes 18 per cent.

The VAT is 7.5% tax on consumption and as well as goods and services.

About N8.8 trillion naira was generated in 2020.

The Federal Government got the support of Ebonyi State Governor Dave Umahi, who said he would prefer that it continued with the collection.

The Rivers State Government asked the Supreme Court to reverse the September 10 order by the Court of Appeal directing parties in the dispute over the administration of VAT to maintain status quo ante bellum.

Rivers, in a notice of appeal filed in the name of its attorney general, also wants the Supreme Court to order the Court of Appeal to assemble a separate panel to hear the appeal, marked: CA/PH/282/2021 filed against the earlier judgment of the Federal High Court, Port-Harcourt, by the FIRS.

In the notice of appeal filed for Rivers by a legal team, led by Emmanuel Ukala (SAN), the appellant raised 10 grounds in support of its prayers.

Rivers said it was dissatisfied with the decision of the Appeal Court, said “directing parties to maintain status quo, that is, to restore parties to the status quo that existed before the judgment of the Federal High Court, Port Harcourt division in suit: FHC/PH/CS/149/2020.”

According to the State, the Appeal Court Justices, who gave the September 10 order, erred in law when they relied on Section 6(6) of the Constitution and the court’s inherent jurisdiction to order parties to maintain status quo, “which they identified as restoring the parties to the position they were before the judgment of the Federal High Court .”

The state said the Justices applied the principle governing the exercise of inherent jurisdiction laid down by the Supreme Court in Shugaba vs Union Bank (1999) 11 NWLR (pt. 627) 459 to the effect that no court had an inherent jurisdiction (except in extreme circumstance) to set aside the exercise of discretion of another court with regard to order made in respect of application for a stay of execution.

It contended, in ground two, that the Justices of the Court of Appeal erred in law when they wrongly assumed jurisdiction to entertain the oral application for maintenance made by lawyer to the FIRS “in spite of the fact that a condition precedent to the invocation of the jurisdiction of the Court of Appeal was not fulfilled by the first respondent (FIRS).

The appellant added that the Court of Appeal failed to appreciate that failure to comply with the condition precedent robbed the court of the requisite jurisdiction to entertain or grant the reliefs sought.

It contended in ground three that the Justices of the Court of Appeal erred in law and breached its (the appellant’s) right of fair hearing when they entertained a vague oral application for maintenance of status quo and went ahead to make orders aimed at maintaining the status quo ante bellum.

Rivers is contending,in ground four that the “Justices of the Court of Appeal erred in law when, in spite of a behemoth of binding precedents on what status quo ante bellum is, they went ahead and made orders for maintenance of status quo ante bellum, without due regard to the undeniable fact that judgment had already been entered in favour of the appellant and which had the practical effect of upturning a valid judgment of a court of competent jurisdiction and its order refusing to grant an injunction pending appeal, at a time when the Court of Appeal was yet to hear the appeal.”

It is contending, in ground five, that the justices erred in law in granting an order for the maintenance of status quo ante bellum, which amounted “effectively to an order for stay of execution and injunction against the declaratory orders of the Federal High Court, on an oral application by the appellant, pending the hearing of the various applications before it, and thus occasioned a miscarriage of justice, to the prejudice of the first respondent -now appellant – (Rivers State).

Ogun State House of Assembly unanimously agreed that when operational, the bill would accord the state its rightful position as a viable federating unit.

The bill “H.B No. 73/OG/2021- A bill for a law to impose and charge value added tax on certain Goods and services, provides for the administration of the tax and for related purposes.”

The motion for the second reading was moved by Majority leader Yusuf Sheriff.

In their contributions, Olakunle Sobukanla, Ganiyu Oyedeji, Adegoke Adeyanju and Abdul Bashir Oladunjoye – underscored the need for the enactment of the proposed law as a federating unit to further improve revenue accruable to the State.

The lawmakers reckoned that a VAT law would ensure a seamless funding of more projects,. They lamented that the state often got less of what it contributed in VAT.

In their submissions, Kemi Oduwole, Oludaisi Elemide, Solomon Osho and Olusola Adams explained that the bill would improve the state’s financial status through tax revenue generation.

Speaker Oluomo lauded his colleagues for their contributions to the debate and committed it to the Committee on Finance and Appropriation for further legislative actions. He fixed the public hearing on the bill for September 23.(The Nation)

The Emir of Bungudu in Zamfara State, Alhaji Hassan Attahiru, was on Tuesday kidnapped along the Kaduna-Abuja highway.
It was learnt that the gunmen opened fire on the convoy of the emir and successfully demobilised some of the vehicles, including that of the traditional ruler, before he was whisked away.

Reliable sources revealed that the incident occurred around Olam Factory, a few kilometres to the city of Kaduna, on his way back from Abuja.

 

Some of his aides who sustained injuries were rushed to the hospital. As of the time of filing the report, there was no official confirmation from the police or the state government.

A Source in the emir’s palace who pleaded for anonymity confirmed that the emir’s convoy was attacked on Tuesday evening.

Speaker, House of Representatives, Hon. Femi Gbajabiamila, has endorsed Lagos State governor, Mr. Babajide Sanwo-Olu, for a second term in office, come 2023, pointing that the governor’s performance in the last two years had surpassed expectations.

This was just as the Speaker representing Surulere 1 Federal Constituency in the green chamber of the National Assembly dismissed his rumoured ambition to contest for the Lagos’ governorship seat in 2023, saying he had “no immediate plan” to contest the seat as the task before him as Number 4 citizen in the country was enormous and tough enough for him to be distracted by the rumour.

Gbajabiamila threw this support on Tuesday in an interview aired on Channels TV, saying Sanwo-Olu had been doing a good job in governing Lagos, notwithstanding the difficult time he had faced in the last two years, stressing that he must not be distracted on the assignment.

Besides, the lawmaker clarified that the fact that the state once had a one-term governor at one time, in person of Mr. Akinwunmi Ambode, doesn’t mean it is going to be the same forever.

Ambode was the immediate past governor, who handed over to the incumbent, Mr Sanwo-Olu, on May 29, 2019.

“The present governor of Lagos State (Sanwo-Olu) is doing a good job. The fact that we had a one-term Governor at one time doesn’t mean it is going to be the same forever.

“This governor is doing a good job under the current circumstances. It’s been a difficult time in his last two years and he has come out well. So, why should anyone upset the apple cart? I think he (Sanwo-Olu) is doing a good job,” Gbajabiamila stated.

On his rumoured ambition, the Speaker said he nursed no ambition to contest for the Lagos’ governorship seat in 2023, declaring that he had no immediate plan for such.

According to him, the task before him as Speaker, House of Representatives was enormous and tough enough for him to be distracted by the rumour.

“That (question) provokes a smile. No, I don’t have any such plan and I don’t have an immediate plan. I have a job I am doing right now; it’s a very tough job. Sometimes, it’s the most difficult job and I say it to people in the world. People don’t understand that, but this is not a forum I’m going to break it down,” he said.

“I don’t want distractions. I am working as a Speaker of the House of Representatives with a lot of responsibilities on my shoulder right now. Any other thing would be a distraction. As for Lagos State Governorship? I have not even thought about it. Why? Because, the present Governor is doing a good job,” he added.

UBA’s Half-year Profit Grows By 33% to N76.2 Billion… Declares 20k per share interim dividend

Africa’s leading financial institution, the United Bank for Africa (UBA) Plc has announced its audited half year financial results for the half year ended June 30, 2021, showing impressive growth across all major income lines and performance indicators.

The pan African financial institution delivered a 33.4 per cent appreciation in its profit before tax which rose to N76.2 billion as at June 2021, up from the N57.1 billion recorded in the same period of 2020. This translated to an annualised Return on Average Equity (RoAE) of 17.5 per cent as against 14.4 per cent a year earlier. This feat was recorded despite the challenging business and economic environment that emerged from the slow pace of activities following the global lockdown occasioned by the Covid-19 pandemic.

The results submitted to the Nigerian Exchange Limited, showed that the group’s profit after tax stood at N60.6 billion, representing a significant rise by 36.3 per cent, compared with the N44.4 billion recorded in the half year of 2020.

Similarly, gross earnings grew to N316 billion, which was a five per cent increase, from the N300.6 billion recorded as at June 2020.
According to the results, at June 30, 2021, the group’s total assets crossed the N8 trillion mark as it increased to N8.3 trillion, up from N7.7 trillion at the end of the 2020 financial year. Its customer deposit also crossed the N6 trillion mark, growing by 7.4 per cent to N6.1 trillion in the period under review, compared with N5.7 trillion as at December 2020.
Furthermore, the group’s Shareholders’ Funds remained robust at N752.5 billion, up from N724.1 billion in December 2020, reflecting its strong capacity for internal capital generation.

In line with the bank’s culture of paying both interim and final cash dividend, the Board of Directors of UBA declared an interim dividend of 20 kobo per share for every ordinary share of 50 kobo each, held by its shareholders.
Commenting on the results, UBA’s Group Managing Director/Chief Executive Officer, Mr. Kennedy Uzoka, expressed delight over the bank’s performance in the first half of the year.

He added: “This has been a strong first half for us, as global economic recovery exceeded expectations, creating a positive rub-off on consumer and corporate confidence, savings and investment activities.
“We saw this positively impact our business, as we continued to leverage our key strategic levers – People, Process and Technology, and our Customer first philosophy, to revolutionise customer experience at UBA.”

He added that the bank’s investment in the Rest of Africa (excluding Nigeria) continues to yield good results for the group.
Uzoka added: “The benefits of pan-African business diversification accruing to the Group is once again evident, with gross earnings and interest income growth of 5.1 per cent and 8.3 per cent respectively, despite the low yield environment in our largest market, Nigeria.
“We are making remarkable progress on our strategy that is progressively positioning UBA as the bank of choice on the continent, driven by our emphasis on tech-led innovation and best customer experience.”

Continuing, the GMD pointed out that the bank recognises the far-reaching effects of the pandemic on businesses globally, and remains focused on its promise to always provide our customers with the best banking experiences possible.

“Our first half 2021 (H1 2021) performance reflects our progressive efforts in building on the strong momentum that we started the year with. As a purpose-driven organisation, we remain resolute in our drive for sustained growth in customer acquisition, transaction volumes and balance sheet, as we consolidate our ‘Africa’s Global Bank’ market position in the years ahead, uplifting livelihoods across the continent,” Uzoka explained.
UBA’s Group Chief Financial Officer (GCFO), Ugo Nwaghodoh, on his part, noted that the bank’s goal was to achieve marked improvement in earnings quality whilst maintaining positive operating leverage as well as top-notch asset quality.

“The Group recorded RoAE of 17.5 per cent (from 15.1% in 2020H1) and a Net-Interest-Margin of 5.8 per cent (from 5.4% in H12020) as we played the volatile yield environment diligently for best return on our interest earning assets.

“Capital position remained strong, with a capital adequacy and liquidity ratios of 23.9 per cent (22.4% in 2020H1) and 58.3 per cent (58.2% in 2020H1) respectively. This is robust enough to support our growth ambitions,” he said.
The GCFO pointed out that even while the operating environment remains largely uncertain and volatile, despite marked improvement from Covid-19 induced macroeconomic stress, UBA will continue to build resilience through its geographically diversified business model to support headline earnings growth for the Group.

“We remain committed to our 18 per cent and 15 per cent respective RoAE and deposit growth guidance for FY 2021, as we continue to invest in growth opportunities across our geographies of operation, whilst managing capital and balance sheet prudently,” Nwaghodoh stated.

How did the process of this mega hospital start?

It started in April 2018. We have several innovations we have put in place to make sure we have seamless health delivery here in ABUADTH.
The first is the reception. You can get registered to access treatment, see a doctor, consultations. All these can be done electronically. We don’t have case files. We don’t give patient a card or make them sign a paper. Once you register here, your information will be available at all the service centers in the hospital.
And if you come back in 20 years, your information will be intact because we have the information stored in a backup cloud

Can you highlight the makeup of the different units?

We have six multifunctional dental chairs that can do a wild range of dental procedures.
You can do dental implants, from basic things like scaling and polishing and they are affordable.

Scaling and polishing can make your teeth whiter and nicer. These chairs can do a single tooth x-ray.
We also have the OPG machine that can do a panoramic view of the entire skull.

ABUADTH

If you want to do a reconstruction surgery from the dental bones and things like that, you will do a reconstruction with the OPG first. We have six chairs, we have one dedicated for Paediatrics.

All the compressors are there, based on this, we have started a dental school here in ABUADTH and they are currently in 200 level going to 300 level and all the specialties are represented here.
We have done all sort of major dental surgeries.

We also have a machine that does the panoramic view of the head. This helps to have the overall view of the skull.

Ekiti does not have an airport. How can emergency cases get here for attention?

We have a helipad. That’s the Helipad. {Pointing to the direction}
The helicopter lands on it, the ambulance goes from here and there is a dedicated road for it, picks up the person and brings him or her straight to the emergency.

We have received several patients through the helipad.

Do you have equipment for Ears, Nose and Throat, ENT infection?

Yes, here in ABUADTH we have. This is the workstation, this is the piece of equipment, {Pointing at equipment}

If there are 100 procedures in ENT, this can do 90 percent. So the patients don’t have to go to the theater.
Once they are here, we can do most of the ENT procedures.

For instance, if a child puts an object in his or her ear, instead of going to the theater looking for it, you can remove all that here. We can remove stuff in the throat, ear and so on.
This equipment, (pointing at a piece of equipment) is a stand-alone piece of equipment. This is very expensive. We have two of them in case we have a lot of patients. But the equipment is very expensive.

Audiology

This is the audiology booth,{Pointing at the machine} for those who have hearing defects.
Patient can go in here and out on the head phones and they are tested for their range of hearing and all that.
We fix patients for hearing aide.

Eye

If patient has eye defects and has undertaken measurement, the glasses are cut immediately and in two hours it is ready.
We have the optician and once you have your records, they do the cutting for you and in two hours you can get your glasses. You don’t have to come back or wait for days.

Cardiac Arrest

If the patient can get here within six hours and gets on this machine (pointing at a machine) the patient has bright chances of recovery.
That is why the helicopter is very important. If there is an accident victim and there is a cardiac arrest at home and the patient gets to the hospital in six hours, the patient goes home the next day. We have received patients from Sokoto, Kano, Lagos anywhere. We have 3 of these.

Heart Surgery

We have an open-heart surgery centre. It is for those that need heart surgeries including deformity of the heart, hole in the heart, atrial septal defects, etc.
They need the theater. We have the machines. We actually have two other machines for backup. When the patient gets here, they open the chest because they cannot operate on a breathing heart.

But sometimes, we can. But we can’t operate while the blood is in there. The blood flows into the heart-lung machine. We paralyize the hearth and work on the heart. When it is completed, the blood flows back into the heart and the machine is used to bring back the heart.

It’s a form of electrical shock and the heart comes back to life.
Then you take the patient back to the ICU, we have done more than 100 since we started. We have someone who does this. He is an Indian and he is on the ground full time. It is very expensive to keep them.

How many theaters do you have in this teaching hospital?

We have 10 theaters and these are modular theaters will full equipment.

These equipment cost so much. But how can average income earners access these facilities?

Yes, you have a point. One of the problems we have in the country is the absence of medical insurance. If the government can make health insurance available to all, medical care will as well be available to all.

However, our founder has ensured that health care in this Teaching Hospital is affordable to all.

Why is this teaching hospital under-publicized?

In the medical profession, we don’t do adverts or any form of publicity. It’s against the regulations of the profession. People get to know we have this equipment here either by referral or when reporters visit hospitals like you are doing.

Which prominent Nigerians have visited this place?

Governor of Kano state, Abdullahi Ganduje’s wife, Hafsat Ganduje, shunned an invitation extended to her by the Economic and Financial Crimes Commission, (EFCC) to report for questioning, last week, over a bribery and land fraud case reported by her son, Abdualzeez.

According to Premium Times, Mrs Ganduje was asked by the anti-graft agency to report last Thursday to its Abuja headquarters.

Abdulazeez had dragged his mum, Hafsat Ganduje, to the EFCC, sources familiar with the matter said.

Governor Ganduje, had previously been involved in a corruption-related scandal.

Abdulazeez reported to the EFCC that he was approached by a property developer to help facilitate the acquisition of some plots of land in Kano with some hundreds of thousands of US dollars and at least N35million as “facilitation commission.”

It was further learnt that Abdulazeez said he paid the sum in dollars to his mother, Mrs Ganduje.

“But three months later, (the property developer) discovered that the plots of land he wanted and had paid the first family for had been allocated to other buyers and he then requested to be refunded,” a source was quoted as saying.

A spokesperson for Kano State Government, Mohammed Garba when asked to comment on the matter said, “I am not aware”.

EFCC spokesperson, Wilson Uwujaren, did not comment on the matter as at presstime on Monday.

Gunmen suspected to be members of the outlawed Indigenous Peoples of Biafra (IPOB) on Monday stormed the Comprehensive Secondary School, Nkume in Njaba Local Government Area of Imo State and stopped students from taking their examination.

According to Daily Trust, the students were preparing to sit for English in the ongoing Junior Secondary School Examination (Junior WAEC) before the hoodlums forcefully dispersed them.

Both teachers and students fled in different directions as the gunmen shot sporadically into the air.

The gunmen set ablaze some motorcycles belonging to some of the staff and students.

Although there were no report of casualties, a video of the incident showed the students and staff shouting and running for their lives.

Police Public Relations Officer, CSP Mike Abattam, could not be reached for comments.

IPOB had declared Monday as sit-at-home to drum support for the release of their leader, Nnamdi Kanu, who is facing some charges before an Abuja High Court.

BREAKING: 240 Inmates Escape As Gunmen Attack Kogi Prison

At least 240 inmates have escaped the Medium Security Custodial Centre (MSCC) in Kabba, Kogi State, following an attack by yet to be identified gunmen.

The Nigerian Correctional Service (NCoS) spokesman, Mr Francis Enobore confirmed the incident in a communique on Monday, stating that the attack took place at about midnight on Sunday.

According to him, the attackers in their numbers arrived at the custodial centre heavily armed and immediately engaged the guards in a fierce gun battle.

Mr Enobore further disclosed that the Comptroller–General, Haliru Nababa has ordered a recapture procedure to be activated immediately and detailed investigation carried out even as he leads a team to assess the situation.

The Comptroller-General also appealed to the general public to furnish security operatives with useful intelligence that will assist in recapturing the escapees.

Kabba MSCC was established in 2008 with a capacity of 200.

As of the time of the invasion, 294 inmates were in custody out of which 224 were pre-trial detainees and 70 convicted inmates.

The latest jailbreak comes a few months after gunmen attacked the Nigerian Correctional Service and the police headquarters in Imo State, freeing 1,844 inmates, after which the hoodlums set the facilities ablaze.

The gunmen also razed the Imo State Police Command headquarters and burnt almost all the vehicles parked at the command’s headquarters. No fewer than 50 cars were set ablaze in the process.

A similar attack was carried out at the correctional centre in Ubiaja, Edo State; however, the jailbreak was foiled by officers at the facility.

The inmates, after breaking out from their cells, engaged the correctional officers in a fight, leaving some of the security personnel injured.

It took a combined effort by officers from the Nigerian Army, 4th brigade, and the Edo command of the Nigeria Police Force, to eventually overpower the inmates and return them to their cells.
